Terms and conditions

The general terms and conditions of the online shop have been drawn up in accordance with the Slovenian Consumer Protection Act (ZVPot), on the basis of the recommendations of the GZS (Chamber of Commerce and Industry of Slovenia) and of international codes of e-commerce.

INTRODUCTION

The online shop (hereinafter “the shop”) is managed by Rastlinjaki Gajšek d.o.o., the e-commerce service provider (hereinafter “the provider”).

The general terms and conditions cover the operation of the shop, the rights of the user and the buyer, and the business relationship between the provider and the buyer.

The provider reserves the right to make changes to the content and other aspects of both the general terms and conditions and the terms of the online shop. Errors are possible, and the provider accepts no responsibility whatsoever for them, except for defects in the product.

AVAILABILITY OF INFORMATION (summary of legislation)

The provider undertakes always to provide the buyer with the following information:

  • the identity of the company (company name and registered office, registration number),
  • contact details that allow the user to communicate quickly and effectively (email, telephone),
  • the essential characteristics of the goods or services (including after-sales services and guarantees),
  • the availability of products (every product or service offered on the website should be available within a reasonable time),
  • the terms of delivery of the product or performance of the service (method, place and time of delivery),
  • all prices must be stated clearly and unambiguously, and it must be clearly shown whether they already include taxes and transport costs,
  • the method of payment and delivery,
  • the period for which the offer is valid,
  • the period within which it is still possible to withdraw from the contract and the conditions for withdrawal, as well as whether returning the product costs the buyer anything and, if so, how much,
  • an explanation of the complaints procedure, including all details of the contact person or customer service department.

METHOD OF PAYMENT

The provider offers the following methods of payment:

  • in cash on receipt (cash on delivery, paid to the delivery service)
  • bank transfer to the account of Rastlinjaki Gajšek d.o.o. (on the basis of a quote / pro forma invoice)

METHODS OF DELIVERY / COLLECTION

The provider offers the following methods of delivery / collection:

  • Delivery by post (the contractual partner is Pošta Slovenija or another delivery service)
  • Collection in person (collection in person is possible at the collection point at Ljubljanska cesta 37, 2310 Slovenska Bistrica.)

The delivery time for products is 3–21 days.

INVOICE

The provider issues the buyer with an invoice on a durable medium, with itemised costs and the necessary instructions and guidance.

The sales contract (order) is kept by the provider and may also be stored in electronic form on the provider's server.

PRODUCT PRICES

Prices apply to payment by the methods of payment listed above, under the conditions stated above. Despite exceptional efforts to provide the most up-to-date and accurate information, a price may be shown incorrectly. In that case, or if the price of an item changes while the order is being processed, the provider will allow the buyer to withdraw from the purchase and will at the same time offer the buyer a solution to the satisfaction of both parties.

The sales contract between the provider and the buyer is concluded at the moment the provider confirms the order. By placing an order, the buyer confirms that they accept the provider's terms of sale. (The buyer receives an email about the order.) From that moment, all prices and other terms are fixed and apply to both the provider and the buyer. Prices valid from 1 January 2016.

PROTECTION OF CHILDREN

The provider may not accept an order from anyone it knows or suspects to be a child without the express permission of their parents or guardians.

The provider may not accept any personal data concerning children without the express permission of their parents or guardians. Nor may the provider disclose data received from children to third parties, with the exception of parents or guardians.

The provider may not offer free access to products or services that are harmful to children.

ORDER CONFIRMATION AND PROCESSING

After placing an order, the buyer receives a notification by email.

If the buyer does not cancel the order within 1 hour, the order goes on for further processing, in which the provider reviews it, checks the availability of the items ordered and confirms the order or rejects it with a reason.

To check details or to ensure accurate delivery, the provider may call the buyer on their contact phone number or choose another suitable means of communication.

On confirming the order, the provider informs the buyer in a suitable way of the expected delivery time.

At this stage, the contract for the purchase of the ordered items between the buyer and the provider is irrevocably concluded.

DELIVERY OF GOODS

The provider prepares and dispatches the goods within the period stated and described above.

RIGHT OF WITHDRAWAL

The buyer has the right to return the purchased goods within the statutory period without any compensation. However, the buyer must bear the costs of returning the item purchased.

The buyer must notify the provider in writing of the intended return no later than 8 days after receiving the goods, at the contact email address info@rastlinjaki-gajsek.si, and return the goods within the further number of days laid down by law.

Returns are not possible for products or materials if the original packaging or the security seal has been removed.

PROTECTION OF PERSONAL DATA

The provider uses appropriate organisational means to protect the transmission and storage of personal data and payments.

The provider undertakes to protect all of the user's personal data permanently.

The provider will use personal data solely for fulfilling the order (sending information material, quotes and invoices) and for other necessary communication.

Under no circumstances will the user's data be passed on to unauthorised persons.

The user / buyer is also responsible for protecting personal data, by ensuring that their own communication is appropriately secure.

MARKETING COMMUNICATIONS

The buyer / user agrees and allows the provider to contact them by means of distance communication, most likely by advertising emails / messages, which will contain the following elements:

  • they will be clearly and unambiguously marked as advertising messages,
  • the sender will be clearly identifiable,
  • various campaigns, promotions and other marketing techniques will be marked as such, and the conditions for taking part in them will also be clearly set out,
  • the way to unsubscribe from advertising messages will be clearly presented. (The provider will expressly respect the user's wish not to receive advertising messages.)

USER (BUYER) OPINIONS / COMMENTS

The website / shop may contain opinions or comments from users and buyers, and product reviews written by buyers. All opinions are part of the shop's functionality intended for the community of users.

The provider allows any user of the shop to write an opinion and send it by email to info@rastlinjaki-gajsek.si, marked “opinion for the website”. The provider reviews opinions before final publication. The provider will not publish opinions or contributions that are in any way offensive or obscene, or that in the provider's opinion offer no benefit to other users and visitors.

By submitting an opinion or comment, the user (or the person sending the opinion) expressly agrees to the terms of use and allows the provider to publish part or all of the text in all electronic and other media. The provider has the right to use the content without time limit and for any purpose that is in the provider's business interest, including publication in advertisements or other marketing communications.

The author of the opinion also declares and warrants that they own the economic and moral copyright in the opinions and comments written, and that they transfer these rights to the provider exclusively and without time limit.

DISCLAIMER

The provider makes every effort to ensure that the information published on its pages is up to date and correct. However, the characteristics of items, delivery times or prices may change so quickly that the provider is unable to correct the information on the website in time. In such cases, the provider will inform the buyer of the changes and allow them to withdraw from the order or to exchange the item ordered.

The provider is not responsible for the content of opinions about items written by visitors. The provider reviews opinions before publication and rejects those that contain obvious untruths or are misleading or offensive. The provider is not responsible for information in opinions and disclaims any liability arising from information in opinions.

Although the provider strives to provide accurate photographs of the items for sale, all photographs should be regarded as illustrative. Photographs do not guarantee the characteristics of the product.

COMPLAINTS AND DISPUTES

The provider complies with the applicable consumer protection legislation. The provider makes every effort to fulfil its duty to establish an effective complaints handling system and to designate a person whom the buyer can contact by phone or email in the event of problems.

Within eight working days, the provider will confirm that it has received the complaint, tell the buyer how long it will take to deal with it and keep them informed of progress throughout.

The provider is aware that an essential characteristic of a consumer dispute, at least as far as court proceedings are concerned, is the disproportion between the economic value of the claim and the costs of resolving the dispute. This is also the main reason why consumers do not take a dispute to court. The provider therefore makes every effort to resolve any disputes amicably.
